Insider Cryptogram Sweepstakes (“Sweepstakes”)

No Purchase or Obligation Necessary. Non-Purchase Entries and Purchase Entries have an Equal Chance of Winning.

1. Eligibility: Sweepstakes is open to residents of New Hampshire. Sweepstakes entrants must be legal U.S. residents who reside in the state of New Hampshire, and who are 18 years of age or older at time of entry. Employees of The Concord Monitor (“Sponsor”), and its parent company and their respective subsidiaries, affiliates, prize suppliers, and advertising and promotion agencies, and their immediate families (spouse, parents, children and siblings and their respective spouses) and individuals living in the same households, whether related or not, are ineligible. Void where prohibited by law. Sweepstakes is subject to all federal, state, and local laws and regulations. By participating, entrants agree to these official rules and accept the decisions of the Sponsor as final in all matters relating to this Sweepstakes.

2. To Enter: The Sweepstakes will be held on a periodic, weekly basis between July 1, 2008, and December 31, 2008 (the “Promotional Period”), with one prize to be won from among all eligible entries received for each weekly prize drawing. Each weekly Sweepstakes will be announced in The Concord Insider, a publication of the Concord Monitor that is published on Tuesdays, with the weekly prize to be drawn the following Monday at noon

There are two ways to enter:

[1] By using newspaper entry form. Complete the Cryptogram form published in The Concord Insider and mail the entry form in an envelope to: Concord Insider Cryptogram, P.O. Box 1177, Concord, NH 03302-1177, or drop it off by hand at our offices at One Monitor Drive, Concord, NH. Only one entry per household. All entries, whether by hand or by mail, must be received by noon on the Monday following publication of the official entry form. Mechanically reproduced entries will not be accepted. Incorrect, inaccurate and incomplete entries are void.

[2] To enter without using the newspaper form. E-mail your answer to the Cryptogram to news@theconcordinsider.com. Or come into the offices of the Concord Monitor, One Monitor Drive, Concord, NH between 8:00 a.m. and 5:00 p.m. weekdays and pick up an Insider Cryptogram form for that week’s drawing. All entries, whether by hand or by mail, must be received by noon on the Monday following publication of the official entry form. Mechanically reproduced entries will not be accepted. Incorrect, inaccurate and incomplete entries are void.

3. Prize Drawing Details: Each week during the Promotion Period a winner will be selected in a random drawing from among all eligible entries correctly completing the Cryptogram on the official entry form. The drawing will be conducted by the Sponsor, whose decisions are final in all matters relating to the Sweepstakes. The actual odds of winning will depend upon the total number of actual eligible entries received.

4. Prize Notification: Each weekly drawing winner will be notified by telephone or mail, and their name and town of residence may be published in the Concord Insider. The winners may be required to complete and sign an Affidavit of Eligibility/Liability Release, and, where legal, a Publicity Release and IRS form W-9, all of which must be returned within 14 days of prize notification or the prize will be forfeited and awarded to an alternate winner. If the Sponsor is not able to contact a prize winner for any reason, the prize will be forfeited and awarded to an alternate winner. All entrants consent to the use of their name, photograph, likeness, biography, voice and/or video for advertising or promotional purposes for this and similar promotions, including newspaper and online announcements worldwide and in perpetuity in any media, now known and hereafter devised (including and without limitation, the internet) without additional compensation, except where prohibited by law. Upon request, each winner will provide consent to such in writing.

5. Prizes: One prize will be awarded each week during the Promotion Period: a $10 gift certificate to the downtown Concord merchant of the winner’s choosing. Total Approximate Retail Value of all prizes awarded during Promotion Period: $260. Sponsor reserves the right, at its sole discretion, to award a prize of greater or equal value. No substitutions or transfers of prize permitted, except at Sponsor’s sole discretion.

6. Use of Entries: Entries become the property of the Sponsor and will not be returned.

7. General Conditions: By participating in the Sweepstakes, entrants release, indemnify and hold harmless the Sponsor, its parent company and its subsidiaries and affiliates, advertising and promotion agencies and all their affiliates, subsidiaries and their respective agents, representatives, officers, directors, shareholders and employees (collectively, “Releasees”) from and against any injuries, losses, damages, claims, actions or any liability of any kind resulting from or arising from participation in the Sweepstakes or acceptance, possession, use, misuse or nonuse of the prize (including any travel or travel related activity thereto) that may be awarded.

Releasees are not responsible for computer, technical, printing, typographical, human or other errors, including, without limitation, errors which may occur in the administration of the Sweepstakes, the announcement of the prizes, the processing of entries or in any Sweepstakes related materials; for transactions or entries that are lost, stolen, late, misdirected, undelivered, delayed, garbled, damaged, incomplete, illegible or postage due mail; for transactions or entries that fail to enter into the processing system, or are reported or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error.

If in the Sponsor’s or judges’ opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the Sponsor and judges reserve the right at their sole discretion to disqualify any individual who tampers with the entry process and or void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to award the prize using all eligible non-suspect transactions and write-in entries received as of the termination date.

As a condition of entering the Sweepstakes, participant, agrees that: a.) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; b.) all causes of action arising out of or connected with this Sweepstakes, or the prize awarded, shall be resolved individually, without resort to any form of class action; and c.) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall attorneys fees be recoverable. Sponsor reserves the right to modify prize award procedures. These official rules shall be interpreted exclusively in accordance with New Hampshire law, and any cause of action arising out of or connected with this Sweepstakes, or the prizes awarded, shall be heard and resolved in either the federal or state courts located in Concord, New Hampshire. If any provision of these official rules shall be held invalid or unenforceable by any court of competent jurisdiction, that holding shall not invalidate or render unenforceable any other provision hereof.

7. Who Won?: For the name of the winner, send your request, noting the date of the weekly prize drawing, with a self-addressed, stamped envelope to: Concord Insider Cryptogram WINNER, Concord Monitor, P.O. Box 1177, Concord, NH 03302-1177. Requests must be received by March 1, 2009.
